Since these <strong>Terms of Sale<\/strong> confer consumer rights to <strong>EU<\/strong> citizens as they are set out in <strong>EU<\/strong> and member state national law, certain <strong>Consumer Protection Legislation<\/strong> may no longer apply to <strong>Consumers<\/strong> based in the <strong>United Kingdom<\/strong>. Please check this page from time to time to take notice of any changes we made, as the <strong>Terms of Sale<\/strong> posted on the <strong>Platform<\/strong> at the time you place your order on the <strong>Platform <\/strong>will govern that particular purchase and shall be binding on you.<\/p><p>In case of any discrepancy or inconsistency between these <strong>Terms of Sale<\/strong> and any other information you may find on the <strong>Platform <\/strong>(including, but not limited to any information on our official support page), the terms and conditions set out in these <strong>Terms of Sale <\/strong>shall prevail.<\/p><p>We may also update other parts of our <strong>Platform<\/strong> from time to time and may change its contents at any time. We also reserve the right to restrict access to parts of our <strong>Platform<\/strong> or indeed the whole <strong>Platform<\/strong>, at our discretion.<\/p><p><strong><u>User account registration<\/u><\/strong><\/p><p>Products in the store can be bought by both unregistered visitors and visitors who have registered their user account.<\/p><p>You can register an account by entering the required information and confirming the registration on the login subpage (i.e., by navigating to the top right icon in the top right corner of the online store).<\/p><p>After receiving your data, the company will contact you with an automated email message sent to the email address you entered, confirming the successful completion of your registration. Upon registration, the <strong>Seller<\/strong> and visitor will store the username and password that the visitor had validly entered during registration.<\/p><p>With successful registration, the visitor becomes a user of the online store. The visitor by registering an account confirms that he accepts these <strong>Terms of Sale<\/strong> in the part that regulates account registration as well as use and cancellation of the user account.<\/p><p>With the successful completion of the registration of the user account, each registered user guarantees the <strong>Seller<\/strong>:<\/p><ul><li>that he provided the <strong>Seller<\/strong> with factually correct data when creating the user account,<\/li><li>that he will use the online store for lawful purposes,<\/li><li>that he will not violate the copyright or intellectual property rights of the <strong>Seller <\/strong>or any third parties when using the online store and when entering data into the fields of the online store.<\/li><\/ul><p>Each registered user must protect the password of his user account and in such a way that he persistently prevents the username and password from falling into the possession of unauthorized persons.<\/p><p>A registered user must not transfer the password to a third party and must not allow third parties to use the online store for their own business or private purposes.<\/p><p>All damages that are directly or indirectly related to the misuse, loss or alienation of the username or password or its part, is borne by the registered user.<\/p><p>For any misuse, loss or alienation of the username or password that is attributable to the intentional or negligent behaviour of the registered user, and as a result of which the <strong>Seller<\/strong> has suffered damage or as a result of which such behaviour has caused damage to a third party, who may subsequently make a claim against the <strong>Seller<\/strong>, the registered user is liable to the <strong>Seller<\/strong> for damages in accordance with the rules of civil law.<\/p><p><strong><u>OBTAINING A COPY ON A DURABLE MEDIUM <\/u><\/strong><\/p><p>You may request that a copy of these <strong>Terms of Sale <\/strong>or the <strong>Terms of Sale<\/strong> which were applicable at the time you purchased a <strong>Product <\/strong>on the <strong>Platform<\/strong> be delivered to you by us on a durable medium. Please direct such requests to <a href=\"mailto:info@budseason.eu\">info@budseason.eu<\/a>.<\/p><p><strong><u>PLACING AND MENDING ORDERS ON THE PLATFORM\u00a0<\/u><\/strong><\/p><p><strong><u>Eligibility to place orders<\/u><\/strong><\/p><p>To place an order on the <strong>Platform<\/strong>, you represent and warrant to <strong>BUDSEASON<\/strong>, that you are:<\/p><p>&#8211; a natural person who is acting for purposes which are outside of his trade, business, craft or profession (hereinafter: \u201c<strong>Consumer<\/strong>\u201d), and<\/p><p>&#8211; that you are at least 15 years of age (or have reached the appropriate age with regards to your country-specific legislation) and thereby have the capacity to enter into the distance contract with <strong>BUDSEASON<\/strong> under these <strong>Terms of Sale<\/strong>, and<\/p><p>&#8211; you are not purchasing the <strong>Products<\/strong> for resell purposes (i.e. you do not intend to resell the <strong>Products<\/strong> to other businesses, consumers, or third parties).<\/p><p>&#8211; you have <strong>read the product description that relates to Food Allergens<\/strong> and other ingredients included in each product.<\/p><p>If the above-stated conditions\u00a0are\u00a0not met, we reserve the right to restrict sales to you.<\/p><p><strong><u>How to place an order<\/u><\/strong><\/p><p>By visiting our <strong>Platform<\/strong> and enabling functional cookies, the available <strong>Products <\/strong>we have on sale shall be displayed to you.<\/p><p>You can scroll through the <strong>Platform <\/strong>and click on <strong>Product <\/strong>images to get more information on each <strong>Product.<\/strong><\/p><p>You can add the desired amount of each <strong>Product<\/strong> into your cart by selecting a bundle or discount option and clicking the \u201c<strong>Add to cart<\/strong>\u201d button in order to proceed to the check-out page.<\/p><p>On the check-out page you are required to enter your delivery information and choose the desired payment method.<\/p><p>You also get a chance to review all of the <strong>Products <\/strong>in your cart as well as their prices, the cost of shipping, the amount you are missing for free shipping, see the total price that you shall be required to pay us and have the option to add more <strong>Products <\/strong>or offers to your cart.<\/p><p>You can then place the order by pressing the \u201c<strong>Place order<\/strong>\u201d button.<\/p><p>Our acceptance of the order takes place when the <strong>Products<\/strong> are shipped to you, whereby we will send you an email confirming that your <strong>Products <\/strong>have been shipped (hereinafter: \u201c<strong>Order Confirmation<\/strong>\u201d).<\/p><p>At this point you enter into a distance contract with <strong>BUDSEASON<\/strong> under these <strong>Terms of Sale<\/strong> (hereinafter: the \u201c<strong>Contract<\/strong>\u201d), whereby you may want to print or download a copy of these <strong>Terms of Sale<\/strong> and the relevant <strong>Order Confirmation<\/strong> for future reference.\u00a0<\/p><p>If we are unable to supply a <strong>Product<\/strong> to you, we will inform you of this in writing and we will not confirm and process the order.<\/p><p><strong><u>Failed delivery of your Order Confirmation<\/u><\/strong><\/p><p>If you have not received an <strong>Order Confirmation<\/strong> email from us and a considerable amount of time (i.e. longer than 45 minutes) have passed since your placed your order, please try:<\/p><p>&#8211; checking your junk mail \/ promotions mail tab as your email software may be marking our emails as junk mail. To stop this from happening, please add <a href=\"mailto:info@budseason.eu\">info@budseason.eu<\/a>\u00a0to your contacts \/ email address book); or<\/p><p>&#8211; contacting us at <a href=\"mailto:info@budseason.eu\">info@budseason.eu<\/a> and describing the situation to our support staff.<\/p><p><strong><u>How to mend an error in an unplaced order<\/u><\/strong><\/p><p>The <strong>Platform<\/strong> will guide you through the steps you need to take to place an order and make payment to us.<\/p><p>Should you desire to mend an error with regards to the contents of your cart, you can always remove a particular <strong>Product <\/strong>from the cart by reducing its amount to 0 or by pressing the \u201c-\u201c button next to\u00a0 the relevant field.<\/p><p>You can also change any data you have entered in the check-out page or return to the previous part of the check-out process by pressing the \u201c<strong>Back<\/strong>\u201d button of your web-browser or by clicking on the company logo or menu in the upper part of the <strong>Platform<\/strong>.<\/p><p><strong><u>How to mend an error in an order you have already placed<\/u><\/strong><\/p><p>You may mend any order provided it has not yet been shipped for delivery. We begin processing orders placed on our <strong>Platform<\/strong> almost immediately.<\/p><p>Should you recognize an error in an order you have already placed, you should contact us at <a href=\"mailto:info@budseason.eu\">info@budseason.eu<\/a> as soon as possible. If the order hasn\u2019t left our warehouse yet we may still mend your order.<\/p><p>If you wish to cancel your order, please see the <strong><u>Cancelling your order prior to delivery<\/u><\/strong> section of these<strong> Terms of Sale<\/strong>.<\/p><p><strong><u>Our right to reject your order or cancel the Contract<\/u><\/strong><\/p><p>Despite our constant efforts to ensure that accurate quantities of all offered <strong>Products<\/strong> are listed on the <strong>Platform<\/strong>, our fulfilment of all orders on the <strong>Platform<\/strong> is subject to<strong> Product <\/strong>availability and stock.\u00a0 We also reserve the right to cancel a <strong>Contract<\/strong> by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the <strong>Contract <\/strong>we cancelled:<\/p><ul><li>you are under 15, or under an older age if an older age is permitted under applicable law to enter into an agreement with<strong>BUDSEASON<\/strong>;<\/li><li>we have adequate reason to believe that you are buying the <strong>Products <\/strong>for resale purposes (i.e. high volume orders, repeat orders, etc.);<\/li><li>there was an obvious error in the price displayed on the <strong>Platform<\/strong>; or<\/li><li>we could not guarantee delivery to the address that you provided;<\/li><li>your billing information is not correct or not verifiable;<\/li><li>the <strong>Product<\/strong> is not available \/ in stock;<\/li><li>your order is flagged up by our security systems as an unusual order or an order susceptible to fraud;<\/li><li>due to an <strong>Event outside our control<\/strong> (see below).<\/li><\/ul><p><strong><u>PAYMENT<\/u><\/strong><\/p><p><strong><u>Payment methods<\/u><\/strong><\/p><p>You can find the payment methods that are available to you on the check-out page, whereby <strong>BUDSEASON<\/strong> offers the following payment methods:<\/p><ul><li>credit cards (as listed on the check-out page),<\/li><li>Google Pay<\/li><li>Apple Pay<\/li><\/ul><p>We do not accept any methods of payment other than those explicitly listed above and available to you on the check-out page and we may not be held liable for any loss of payment or any other damages that may result from payments that are not made through the available methods and through the subsequent payment related input fields.<\/p><p><strong><u>Cash on delivery (COD)<\/u><\/strong><\/p><p>If you have chosen cash on delivery as your preferred method of delivery and payment on the check-out page (where such option is available):<\/p><p>&#8211; we have discretion to reject certain modes of payment;<\/p><p>&#8211; we only accept payments in the local currency; and\/or<\/p><p>&#8211; if you do not accept the order or make full payment at the time of delivery, we reserve the right to refuse to deliver \/ transfer the title on the <strong>Products<\/strong>.<\/p><p><strong><u>Payment processing<\/u><\/strong><\/p><p>The time at which you&#8217;ll be charged for your order will depend on the payment method you selected at checkout. Payments can only be processed if the billing information can be verified.\u00a0\u00a0<\/p><p>If you pay by credit \/ debit card, we shall try to deduct the amount due from your account as soon as you submit your order.\u00a0<\/p><p>In the event that no payment has been received by us at the time you place the order, no <strong>Order Confirmation<\/strong> shall be generated and sent to your email and your order shall be deemed as cancelled.<\/p><p>Please note, that we retain full legal title in any and all <strong>Products<\/strong> until we have received full payment.<\/p><p><strong><u>PRICES AND CURRENCY<\/u><\/strong><\/p><p>All <strong>Products <\/strong>prices on the <strong>Platform<\/strong> include <strong>Value Added Tax (VAT) <\/strong>and are generally quoted in the <strong>Euro (EUR)<\/strong> currency. The amount of <strong>Value Added Tax (VAT) <\/strong>shall be displayed on the invoice.<\/p><p>Please note that changing the country of delivery may have an influence on the price due to a change in currency or to country specific pricing.\u00a0<\/p><p><strong><u>Costs of delivery<\/u><\/strong><\/p><p>The cost of shipping the <strong>Products <\/strong>to your location (hereinafter: the \u201c<strong>Costs of delivery<\/strong>\u201d) are applied per order and are displayed on the check-out page and on the invoice. The <strong>Costs of delivery<\/strong> depend on the country where your order is being delivered to.<\/p><p>If your cart meets or exceeds the free delivery (also \u201cfree shipping\u201d) threshold of <strong>50 EUR<\/strong>\u00a0 that is displayed and updated in real time on the check-out page, you will not be charged for the standard delivery of the <strong>Products <\/strong>in your order, whereby free shipping is offered for all orders, where the sum of the prices of the <strong>Products <\/strong>contained in the order meets or exceeds the amount listed on check-out page.<\/p><p><strong><u>Your total price<\/u><\/strong><\/p><p>The total price is specified on the check-out page and includes <strong>Value Added Tax (VAT)<\/strong> and the <strong>Costs of delivery<\/strong>. It is also recorded in the <strong>Order Confirmation<\/strong>, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency.\u00a0<\/p><p>If your local currency is different from the currency in which the prices are quoted, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.\u00a0<\/p><p><strong><u>PRICE CHANGES<\/u><\/strong><\/p><p>The prices of the <strong>Products<\/strong> will be as displayed on the <strong>Platform<\/strong>. Prices may change from time to time, but changes will not affect any order for which you received our <strong>Order Confirmation<\/strong>.<\/p><p><strong><u>DELIVERY<\/u><\/strong><\/p><p>Delivering <strong>Products<\/strong> that are in stock to countries in the <strong>EU<\/strong> usually takes 2 to 5 days, while delivering to certain countries might also take 14 or more days.\u00a0<\/p><p>For <strong>Products <\/strong>not currently in stock, the delivery time may be up to 15 days.\u00a0<\/p><p>We do not ship on certain public holidays.<\/p><p>Delivery of an order shall be completed when we deliver the <strong>Products<\/strong> to the address you gave us.<\/p><p>Our carrier may contact you to arrange deliveries, confirm delivery details and rearrange deliveries (where applicable) from time to time.<\/p><p><strong>Products<\/strong> are shipped to you based on the information which you provide to us and you are responsible for the accuracy of such information. If any regulations are breached (including but not exclusively export\/import regulations) due to inaccurate information provided by you then you are responsible for such breach.<\/p><p><strong>Please note:<\/strong> these time frames are given for normal (i.e. non-pandemic) circumstances, whereby depending on your location and applicable regulations, there might be slight delays on top of regular delivery times should <strong>Events outside our control<\/strong> (i.e. Covid-19 lockdowns) occur.<\/p><p><strong><u>Tracking code<\/u><\/strong><\/p><p>After your order has been dispatched, you shall receive a message from us containing your delivery tracking code. This code will allow you to track the delivery of your <strong>Products<\/strong> (where such service is made available).<\/p><p><strong><u>Failed delivery<\/u><\/strong><\/p><p>If no one is available at your address to take delivery, the carrier may leave a delivery attempt notice to advise that the order has been returned to their local depot. If this occurs, please contact the carrier at the number listed on the delivery attempt notice.<\/p><p>You may try reviewing the location of your order through the supplied tracking code or reviewing your email inbox for any delivery status messages from our carrier.<\/p><p>If you have further issues, please contact us at <a href=\"mailto:info@budseason.eu\">info@budseason.eu<\/a>.<\/p><p><strong><u>RETURNS &amp; CANCELLATIONS<\/u><\/strong><\/p><p><strong><u>Cancelling your order prior to delivery<\/u><\/strong><\/p><p>You may cancel any order free of charge and without giving us any reason, provided it has not yet been shipped.
